OVERVIEW

Domazz is an online store operated by Bruno Hernán Mazzei from Argentina under the trading name “Domazz”. Throughout these Terms of Service, the terms “Domazz”, “we”, “us” and “our” refer to Bruno Hernán Mazzei trading as Domazz.

Domazz operates this website and offers products and related services to customers, including customers located in Australia. Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer these services.

By visiting our website, creating an account or placing an order, you agree to these Terms of Service and to the policies referenced in them. If you do not agree, you should not use our services.

Nothing in these Terms excludes, restricts or modifies any consumer right or remedy that cannot legally be excluded, including rights that may apply under the Australian Consumer Law.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your place of residence, or have the permission of a parent or legal guardian, to purchase from Domazz.

You agree to provide accurate, current and complete contact, billing, payment and shipping information. You are responsible for protecting your account credentials and for activity conducted through your account.

SECTION 2 — PRODUCTS AND DESCRIPTIONS

We make reasonable efforts to display product descriptions, specifications, colours and images accurately. The appearance of colours may vary depending on the device and display settings used.

Products supplied must correspond with their descriptions and meet any consumer guarantees required by applicable law. Nothing in these Terms limits your rights when a product is faulty, unsafe, materially different from its description or otherwise fails to comply with a mandatory consumer guarantee.

We may update product descriptions, prices and availability or discontinue products. These changes will not affect an order that we have already accepted, except where required to correct an obvious error or comply with the law.

SECTION 3 — ORDERS

Submitting an order constitutes an offer to purchase. An order is accepted when we send confirmation that it has been accepted or dispatched.

We may refuse or cancel an order for a lawful reason, including suspected fraud, an obvious pricing error, product unavailability or an inability to deliver to the address provided. If we cancel an order after receiving payment, we will refund the amount paid for the cancelled products.

Please review your information carefully before submitting an order. If you need to change or cancel an order, contact us promptly at domazztecnologia@gmail.com. We cannot guarantee that a change or cancellation will be possible after processing or fulfilment has started.

SECTION 4 — PRICES AND PAYMENT

Prices are displayed in Australian dollars (AUD) unless clearly stated otherwise.

Any applicable shipping charges, taxes or other charges collected by Domazz will be disclosed before the order is completed. Your payment provider may apply currency-conversion or other charges that are outside our control.

You agree to provide valid payment information and confirm that you are authorised to use the selected payment method.

Promotional offers may be subject to separate conditions. If promotional conditions conflict with these Terms, the specific promotional conditions apply to that promotion, subject to mandatory consumer law.

SECTION 5 — SHIPPING AND DELIVERY

Domazz currently sells and delivers products to eligible addresses in Australia unless otherwise stated on the website.

Available shipping options and any applicable charges will be displayed at checkout. Delivery dates and transit times are estimates unless we expressly agree to a guaranteed delivery date.

Delivery may be completed by a third-party supplier or shipping carrier. However, using a supplier or carrier does not remove any responsibility that Domazz has to the customer under applicable law.

Customers must provide a complete and accurate delivery address. Contact us promptly if you notice an address error. We cannot guarantee that an address can be changed after fulfilment has started.

If an order is lost, damaged in transit, not supplied within an agreed time or not supplied within a reasonable time, contact us at domazztecnologia@gmail.com so that we can investigate and provide any remedy required by applicable law.

SECTION 6 — RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds and cancellations are governed by our Refund Policy, available through the footer of our website, together with all mandatory rights provided by applicable consumer law.

Our Refund Policy does not exclude or limit remedies available for faulty, unsafe, incorrectly described or otherwise non-compliant products.

Change-of-mind returns, where offered, may be subject to the conditions stated in our Refund Policy.

SECTION 7 — AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Domazz is the seller responsible for handling customer requests concerning products purchased through this store. We will not require a customer to deal exclusively with the manufacturer or dropshipping supplier when Domazz is legally responsible for providing a remedy.

SECTION 8 — INTELLECTUAL PROPERTY

Unless otherwise indicated, the website’s content, branding, text, graphics, layout and original materials are owned by or licensed to Domazz and are protected by applicable intellectual-property laws.

You may use the website only for personal, lawful and non-commercial purposes. You must not copy, reproduce, distribute, modify or commercially exploit protected website content without permission from the relevant rights holder.

Third-party trademarks, product images and brand names belong to their respective owners.

Domazz is powered by Shopify, which provides the ecommerce platform used to operate the store.

Purchases made through this store are transactions directly between the customer and Domazz. Shopify is not the seller of products offered by Domazz and is not responsible for fulfilling customer orders or providing remedies on behalf of Domazz.

Nothing in this section limits any rights that cannot legally be excluded.

SECTION 11 — PRIVACY

Personal information collected through our services is handled in accordance with our Privacy Policy, available through the footer of our website.

Because the store is hosted by Shopify, customer information may be processed by Shopify and by service providers involved in payments, fraud prevention, fulfilment, delivery and store operation. Further information is provided in our Privacy Policy.

SECTION 12 — REVIEWS AND FEEDBACK

If you submit a product review, comment, suggestion or other feedback, you confirm that you have the right to submit it and that it is not unlawful, misleading, abusive or infringing.

You grant Domazz permission to display and use submitted feedback for operating and promoting the store. We may moderate or remove feedback when reasonably necessary, but we are not required to publish every submission.

SECTION 13 — ERRORS AND AVAILABILITY

We may correct typographical errors, inaccurate product information, pricing mistakes or availability errors.

If an error materially affects an order that has already been placed, we will notify the customer and provide any cancellation, refund or other remedy required by applicable law.

Termination does not affect rights, payment obligations or remedies that arose before termination.

To the maximum extent permitted by law, Domazz does not guarantee uninterrupted or error-free access to the website and is not responsible for losses caused solely by circumstances outside its reasonable control.

Nothing in these Terms excludes, restricts or modifies:

  • Any guarantee, warranty, right or remedy that cannot legally be excluded.

  • Liability for fraud, wilful misconduct or any other liability that cannot legally be limited.

  • Rights or remedies available under the Australian Consumer Law when it applies.

Where liability can legally be limited, Domazz’s liability will be limited only to the extent permitted by applicable law.

SECTION 17 — INDEMNIFICATION

To the extent permitted by law, you agree to compensate Domazz for losses directly resulting from your unlawful use of the website or your material breach of these Terms.

This section does not apply to losses caused by Domazz and does not limit any non-excludable consumer right.

SECTION 18 — SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful or unenforceable, it will be modified or removed only to the minimum extent necessary. The remaining provisions will continue to apply.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

SECTION 19 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws applicable to the transaction and to the parties.

Domazz operates from Argentina and sells to customers in Australia. Nothing in these Terms excludes any mandatory consumer protection that applies in Australia or restricts a customer’s right to bring a claim before a court, tribunal or authority that has jurisdiction under applicable law.

SECTION 20 — CHANGES TO THESE TERMS

We may update these Terms when our services, suppliers, practices or legal obligations change.
